End User License Agreement (EULA)

Effective Date:

This End User License Agreement (“Agreement”) is a legally binding agreement between you (“User” or “You”) and Sleepy Monsters GmbH (“Company,” “We,” or “Us”) governing your download, installation, and use of the mobile game “Oaks & Austrians” (“Game”), available through the Apple App Store.

By downloading, installing, accessing, or using the Game, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not download, install, or use the Game.

1. License Grant

Subject to your compliance with this Agreement, the Company grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Oaks & Austrians on any Apple device that you own or control and as permitted by the Apple App Store Terms of Service.

You may not:

  • Reproduce, distribute, publicly display, or perform the Game for commercial purposes.
  • Transfer, sublicense, or otherwise commercialize the Game.

2. Eligibility & Age Requirement

The Game is intended for users aged 10 and older.

If you are under the age of 18, you must have your parent or guardian’s consent to download and use the Game. By using the Game, you affirm that you meet the age requirement and, if under 18, have received such consent.

3. In-App Purchases (IAP)

The Game may offer In-App Purchases that allow you to acquire virtual items, characters, coins, or other gameplay-enhancing features.

  • Purchases are non-refundable, non-transferable, and have no real-world value.
  • All transactions are processed through the Apple App Store and governed by Apple’s payment terms and conditions.
  • The Company reserves the right to modify or discontinue any virtual items or content with or without notice.
  • If you delete the Game or your device’s data is lost, your In-App Purchases may be lost. Restoration of purchases is not guaranteed.

4. Advertisements & Rewarded Ads

The Game may display third-party advertisements and provide opportunities to view advertisements in exchange for in-game rewards (“Rewarded Ads”).

  • By choosing to view a Rewarded Ad, you agree to receive the associated reward as described in the Game.
  • The Company is not responsible for the content, accuracy, or availability of third-party advertisements and does not endorse any advertised products or services.
  • Third-party advertising networks may collect certain data from your device, as governed by our Privacy Policy.

5. Data Collection & Privacy

By using the Game, you agree to the collection and use of your data as described in our Privacy Policy [Insert Link to Privacy Policy].

  • The Game may collect device information, gameplay statistics, IP address, and advertising identifiers to enhance your experience and deliver personalized ads.
  • For users under 13, the Game is designed to comply with COPPA (Children’s Online Privacy Protection Act) and other applicable privacy laws.

6. Ownership & Intellectual Property

The Game, including all content, graphics, characters, software, and related materials, is owned by Sleepy Monsters GmbH and is protected by copyright, trademark, and other intellectual property laws.

You agree not to:

  • Copy, modify, distribute, or create derivative works of the Game.
  • Reverse-engineer, decompile, or otherwise attempt to extract the Game’s source code.

7. Restrictions & Prohibited Conduct

You agree not to:

  • Use the Game for any illegal or unauthorized purpose.
  • Attempt to interfere with the Game’s servers or networks.
  • Exploit bugs, errors, or vulnerabilities for unfair advantages.
  • Use cheats, automation software, bots, hacks, or other unauthorized third-party software.

8. Termination

This Agreement is effective until terminated by either party.

The Company may terminate your access to the Game at any time, with or without notice, if you violate this Agreement or engage in prohibited conduct. Upon termination, you must cease all use of the Game and delete all copies from your devices.

9. Disclaimer of Warranties

The Game is provided “as is” and “as available” without warranties of any kind, whether express or implied. Sleepy Monsters GmbH does not warrant that the Game will be error-free, uninterrupted, or free from harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, Sleepy Monsters GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Game, including but not limited to loss of data, revenue, or business opportunities.

11. Governing Law & Dispute Resolution

This Agreement shall be governed by the laws of Austria, without regard to conflict of law principles.

Any disputes arising out of or relating to this Agreement shall be resolved exclusively in the courts located in Austria.

12. Changes to This Agreement

The Company reserves the right to modify or update this Agreement at any time. Notice of significant changes will be provided through the Game or via other reasonable means. Your continued use of the Game following such changes constitutes acceptance of the revised Agreement.

BY DOWNLOADING OR USING THE GAME, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT.
